Privacy Statement for Applicants 

This privacy statement (“Statement”) explains how Takeaway.com Group B.V. and its subsidiaries and affiliates (“JET”, “we”, “us” or “our”) collect, use, disclose, and otherwise process personal data and applies to the processing of personal data of applicants that apply for vacancies with JET. 

What personal data we process and why 

Personal data, in this Statement also referred to as “your data”, means any information or set of information from which we are able, directly or indirectly, to personally identify you, in particular by reference to an identifier, e.g. name and surname, email address, phone number, etc. It does not include data where the identity has been removed (anonymous data).  

We collect your data directly from you, whether that be face-to-face or electronically via virtual meetings or forms.

At JET we are committed to protecting the privacy of everyone in the community and would like to inform you via this Statement regarding the personal data processed within the application and recruitment process at JET and the way we process your personal data and the purposes of the processing.


     1. Application process 

JET processes personal data about you because you have applied for a vacancy with JET. We process your data for the selection process and hopefully to welcome you in the future as an employee of JET. The legal ground for this processing is that we consider your application as a request to take steps prior to entering into a contract (employment agreement) for us to comply with legal obligations or to pursue our legitimate interests, and/or any other legal basis otherwise permitted in accordance with the applicable data protection regulation. Where legally required or permitted, we may process your personal data based on your consent. If we rely on your consent as a legal basis for processing your personal data, you may withdraw your consent at any time.

JET values diversity and inclusion. Equal employment opportunities mean we offer equal treatment to all applicants. In order to ensure equal employment opportunities as permitted or required by local law we may gather sensitive personal data or gender data for this purpose.

Upon your request we will offer you support and assistance via talent acquisition teams and our communication channels. Per your preferences, we will contact you by phone call, or email messaging, to provide you with information relating to your application and to fulfil your requests. If you expressed interest in personalised job opportunities recommendations, we may inform you of available opportunities for employment within JET. 

     2. Application assessments 

JET may ask you to perform an assessment during the application process. These assessments are conducted to get a good understanding of your competencies. Your answers in assessments will be evaluated, possibly in an automated manner (for more information see the automated decision making section), and based on the evaluation the decision about your application will be made. The legal ground for this processing is that we consider the assessments as necessary to take steps prior to entering into a contract (employment agreement).      3. Applicant Satisfaction Research 

To make sure that our services are aligned with your preferences and to improve our services and platforms, JET may approach you to conduct research; such as but not limited to, surveys. We only send you these types of communications with your prior consent, unless this is not necessary according to the applicable law. Participation in this research is completely voluntary. If you do not wish to receive these surveys you can unsubscribe from them in the accompanying messages. We may process the following personal data for the purposes described above:

     4. Background and/or reference check

During the application process JET may require you to provide information for or conduct a background and/or reference check. These checks are only performed if legally allowed and if JET deems this to be necessary for the job that you applied to. The legal ground for this processing is that we consider your application as a request to take steps prior to entering into a contract (employment agreement), for us to comply with legal obligations or to pursue our legitimate interests, and/or any other legal basis otherwise permitted in accordance with the applicable data protection regulation. Where legally required or permitted, we may process your personal data based on your consent. If we rely on your consent as a legal basis for processing your personal data, you may withdraw your consent at any time.      5. Information JET may collect through other sources 

To the extent permitted by applicable law, in addition to our recruitment channels or career websites, we may also obtain information about you from other sources, such as through your interactions with JET employees or from third parties, such as recruiters, recruitment agencies, social media platforms like LinkedIn or other websites on the Internet (subject to such third parties privacy notices). The legal ground for this processing is that we consider your application as a request to take steps prior to entering into a contract (employment agreement), for us to comply with legal obligations or to pursue our legitimate interests, and/or any other legal basis otherwise permitted in accordance with the applicable data protection laws. Where legally required or permitted, your consent. If we rely on your consent as a legal basis for processing your personal data, you may withdraw your consent at any time.We may process the following personal data for the purposes described above:

     6. Analytics 

JET may also use your personal data to analyse your use of JET applications and/or third party tools used within the JET organisation, in order to improve the applications/tools you use and monitor performance of these applications/tools where applicable. The legal basis for this processing operation is that it is needed in pursuing a legitimate interest of JET (analysis & reporting) as defined in applicable laws. Where legally required or permitted, we may process your personal data based on your consent. If we rely on your consent as a legal basis for processing your personal data, you may withdraw your consent at any time. Furthermore, we process data you indirectly provide to us, because JET uses cookies for functional, analytical and personalised  purposes.      7. JET Premise visits 

If you visit our premises, for security reasons and in line with local requirements we might  record your visits on our premises through video or other electronic, digital, or wireless surveillance systems or devices (e.g. CCTV). The legal basis for this processing operation is that it is needed in pursuing a legitimate interest of JET as defined in applicable data protection laws. 

     8. Fraud prevention and Blacklisting 

We also process personal data to prevent fraud and prevent other forms of misuse on and via our services such as rejecting an applicant behaving inappropriately (for example use of discriminatory language, sexism, racism, fake documents, rude language / behavior or unprofessional behavior or similar) during the recruitment process. The legal basis for this processing activity is that it is needed in pursuing a legitimate interest of JET (fraud prevention) or complying with our legal obligations. Personal data that may be processed for fraud prevention purposes are:

     9. Contests and campaigns 

JET may from time to time organise contests or campaigns for you. Your participation in these contests is always voluntary and based on your consent. If we rely on your consent as a legal basis for processing your personal data, you may withdraw your consent at any time. The personal data processed for these contests and/or campaigns depend on the specifics of that contest/campaign. 


Additional purposes 
We will only use your personal data for the purposes described above, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If we want to use the data for a different purpose, we will take appropriate measures to inform you, consistent with the significance of the changes we make. Please note that we may process your personal information without your knowledge or consent, in compliance with the above rules, where required or permitted by applicable law.

We may use your data to create data in aggregate and/or de-identified format to be able to conduct internal research and analytics, improve our application process and any other legally permissible purpose.


Automated decision-making and profiling 
For the purposes described above we may use automated decision-making and profiling. Automated decision-making takes place when an electronic system uses personal data to make a decision without human intervention. We make sure measures are in place to safeguard your rights when we use automated decision-making. 

You will not be subject to decisions that will have a significant impact on you based solely on automated decision-making, unless we have a lawful basis for doing so and we have notified you. If you want to object to this type of processing, you can contact us via our privacy form. We will then proceed to reassess the situation and/or provide you with more information about why and how such automated decision was made. 

Age 
Our website and vacancies are not intended for persons defined as underage by applicable local laws, nor do we intend to collect personal data of website visitors who are under the defined legal age. However, we are unable to verify visitors’ or applicants' ages. We therefore advise parents and/or legal guardians to monitor their children's online activities, to prevent their personal data being collected without parental or guardian consent. Sharing with others 
JET may work with other companies within the JET group and other third parties in order to carry out the processing described above. 

These group companies and third parties may process your personal data on behalf of us as data processors or as autonomous data controllers (or in a position as so defined or referred under applicable data protection law; including concepts as the equivalent of controller or processor), and have access to your personal data for the purposes described in this privacy statement. We require group companies and third parties to protect it in accordance with the standards set out in this privacy statement and we take appropriate measures pursuant to the applicable data protection laws to guarantee the same level of protection and confidentiality of your personal data.  

We may also share your personal data with other third parties where appropriate or required by applicable law or regulation (including a court order or legal authority request) or where we believe disclosure is necessary to exercise, establish or defend legal rights or to protect the vital interests of any person. Such third party controllers may include law enforcement agencies. 

We may also disclose your personal data to any company or prospective buyer of all or substantially all of our assets in connection with any sale or transfer of those assets.

Our website may include links to third-party websites. When accessing such third-party websites, bear in mind that each of these websites has its own privacy statement. Although JET takes great care in selecting websites to link to, we cannot take responsibility for the way in which they handle your personal data.

Where your data gets sent 
JET operates, and processes personal data globally. This may result in processing of your personal data in countries, including the United States, whose data protection laws may differ from those where you live.
If you are in the European Economic Area (EEA), Switzerland, Israel, Australia, and the UK please be aware that we may process and/or transfer your personal data outside of these aforementioned countries. This may include transferring it to or accessing it from other jurisdictions, including jurisdictions that may not provide a level of protection equivalent to the your local- and/or data protection laws (“Non-Adequate Country”). You may see the list of Adequate Countries here as adopted by the European Commission. 

When we transfer personal data outside the countries listed here we adhere to applicable and appropriate safeguards and transfer mechanisms to ensure safe transfer of your personal data. We provide appropriate and adequate protection for the transfers of personal data to countries outside of the aforementioned countries through a series of agreements with our service providers based on Standard Contractual Clauses adopted by the European Commission (and their approved equivalents for the UK and Switzerland), and the EU-U.S. Data Privacy Framework (“EU-U.S. DPF”), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (“Swiss-U.S. DPF”), as set forth by the U.S. Department of Commerce.

You may request a copy of the contractual clauses applicable to transfer of your personal data depending on which country your personal data may be transferred to.

In addition to appropriate contractual safeguards we adopt following organisational and technical measures for protection of your personal data during its transfer outside of the aforementioned countries including:

  • securing personal data when in transit, including through encryption, and at rest;
  • mandating training regarding privacy and data security at JET;
  • implementing internal policies and procedures to limit access to, and use of customer personal data; and
  • limiting unauthorised  access to your personal data, except where required by applicable law or you have consented to the access.

How long we keep your data 
JET, as a globally operating company, has to take into account various local data retention requirements. We will only retain your personal data for as long as necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. To determine the appropriate retention period for personal data, we take into account the following criteria:

(i) the period required to serve the respective business purpose;
(ii) to the extent reasonably necessary to comply with an applicable legal requirement; or
(iii) as advisable in light of an applicable statute of limitations.

In the event the data falls into more than one retention terms category, the category with the longer retention requirement shall prevail, other requirements (such as access, security etc) notwithstanding.

How to exercise of privacy rights or complaints

If you have any questions about your privacy rights or you wish to exercise the abovementioned rights you may contact us via our privacy form or the contact details set out below.

We will do our best to address your request in time and free of charge, except where it would require an excessive and disproportionate effort. In certain cases, we may ask you to verify your identity before we can act on your request.

Regarding requests related to processing or sharing of personal data related to JET for Business, please contact the employer that grants you the JET for Business allowance (which might be your employer, business partner etc.). This is required because JET and the person that grants you the allowance have a separate responsibility with respect to the processing and protection of your personal data.

We inform you that, with regard to your personal data, you can exercise the rights provided for by, and pursuant to applicable data protection laws, which may include:

Right of access

You have the right to access and be informed about your personal data processed by us. You can request a copy of your personal data by contacting us.

Right to withdraw consent

In case the processing is based on a consent you may withdraw your consent at any time free of charge. Withdrawing a consent may lead to fewer possibilities to use our Services. The withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.

Right to rectify

You have the right to have incorrect or incomplete personal data we have stored about you corrected or completed by contacting us. You can correct or update some of your personal data through your customer account.

Right to erasure

You may also ask us to delete your personal data from our systems. We will comply with such a request unless we have another legal ground to not delete the data in terms of applicable laws.

Right to object

You may have the right to object to certain use of your personal data if such data is processed for other purposes than necessary for the purposes set out in this Statement or for compliance with a legal obligation. If you object to the further processing of your personal data, this may lead to fewer possibilities to use our Services.

Right to restriction of processing

You may request us to restrict processing of personal data for example when your data erasure, rectification or objection requests are pending and/or when we do not have other legal grounds to process your data. This may however lead to fewer possibilities to use our Services.

Right to data portability

You have the right to receive your personal data processed in accordance with this Statement in a machine-readable format, so that you can store this data in a database of yours or of a third party.

Right to lodge a complaint 

You have the right to lodge a complaint with the relevant supervisory authority if you consider that processing of your personal data is infringed. 


Security 
JET takes personal data protection seriously and we therefore take appropriate measures to protect your personal data against misuse, loss, unauthorised access, unwanted disclosure, and unauthorised alteration. 

Within JET we limit the access to your data as much as possible and only provide our employees access to your data on a “need-to-know” basis.
